1. About Spellcast

Spellcast ("the Service") is a spelling practice application for UK primary school children, operated by Made Good Software ("we", "us", "our") and accessible at spellcast.academy. By creating an account and using Spellcast, you agree to these Terms & Conditions.

If you do not agree with any part of these terms, please do not use the Service.

2. Eligibility and Accounts

Parent accounts may only be created by individuals aged 18 or over. By creating a parent account, you confirm you are 18 or older.

Child accounts may only be created by the parent or guardian who holds the associated parent account. You are responsible for ensuring your child uses the Service appropriately.

You are responsible for keeping your account credentials secure. You must notify us immediately at support@spellcast.academy if you suspect unauthorised access to your account.

3. Free Trial

New parent accounts receive a 14-day free trial with full access to all features. No payment details are required to start the trial.

At the end of the trial period, access to spelling sessions will be restricted unless you subscribe. Your account data and progress are retained; you may subscribe at any time to regain full access.

4. Subscriptions and Payment

Plans

  • Monthly: £2.99 per month
  • Annual: £19.99 per year

All prices include VAT where applicable.

Billing

Payments are processed securely by Stripe. Your subscription renews automatically at the end of each billing period. You will receive a receipt from Stripe for each payment.

Cancellation

You may cancel your subscription at any time via the "Manage subscription" option in your account settings. Cancellation takes effect at the end of your current billing period — you retain access until then. We do not provide refunds for partial billing periods.

Price changes

We will give at least 30 days' notice of any price changes by email and in-app notification.

Lifetime Free accounts

Some accounts are granted complimentary lifetime access at our discretion (e.g. early testers, partners). These accounts are non-transferable and may be revoked if the account is found to be in breach of these terms.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Share your account credentials with anyone outside your immediate family
  • Attempt to reverse-engineer, scrape, or interfere with the Service
  • Create accounts using false information
  • Use the Service in any way that could harm, disable, or impair it

We reserve the right to suspend or terminate accounts that breach these terms without refund.

6. Intellectual Property

All content, design, software, word lists, and branding within Spellcast are owned by or licensed to us. You may not copy, reproduce, distribute, or create derivative works without our written permission.

The National Curriculum word lists incorporated into Spellcast are derived from statutory guidance published by the Department for Education (DfE) under the Open Government Licence.

7. Disclaimers

Spellcast is provided as an educational aid. We make no guarantee that use of the Service will result in improved spelling attainment.

The Service is provided "as is". We do not warrant that it will be uninterrupted, error-free, or completely secure. We will use reasonable endeavours to maintain availability but cannot guarantee 100% uptime.

8. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

9. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated terms.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising from use of the Service — including any failure to meet availability targets — shall not exceed the total subscription fees you paid in the 12 months preceding the claim.

We are not liable for any indirect, consequential, or economic losses, including loss of data, loss of revenue, or business interruption.

Nothing in these terms excludes liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under UK law.

11. Cessation of Service

We are committed to giving you fair warning if we ever have to close Spellcast, and to making sure you can take your data with you.

Planned closure

If we decide to shut down the Service, we will give you at least 90 days' written notice by email before the service stops. Throughout that notice period, you can export all your data at any time — parents via account settings, schools via the teacher dashboard.

Once the notice period ends, all personal data will be permanently deleted within 30 days.

Refunds

If you are on a paid subscription when a planned closure is announced, we will issue a pro-rata refund for any unused portion of your current billing period, processed via Stripe to your original payment method.

Emergency closure

In rare circumstances — for example, a serious security breach requiring immediate shutdown — we may not be able to give 90 days' notice in advance. In that situation, we will notify you as soon as we reasonably can and will aim to give you at least 30 days to export your data before it is deleted. We will be transparent about what happened and why.
